Citizens of Ukraine (as well as citizens of the Republic of Belarus and the Russian Federation, or persons with stateless status in these three countries) have the opportunity to obtain the Pole's Card on the territory of Poland in accordance with the Regulation of the Council of Ministers of 1 July 2022 amending the regulation on the appointment of the voivode competent to conduct proceedings for the granting or extension of the validity of the Pole's Card. This means that currently, Ukrainian citizens have two options for applying for the granting or replacement of the Pole's Card: at the relevant Polish Consulate or at the voivodship office/delegation of the voivodship office competent for the place of residence in Poland. The Pole's Card is a document that confirms one’s affiliation with the Polish nation. It is worth emphasizing that it is not an equivalent of a residence permit (so-called residence card), nor is it equivalent to Polish citizenship, so the Pole’s Card itself does not entitle neither to legal reside0nce in the territory of the Republic of Poland nor to cross the state border. However, it does provide a number of other rights, including:

- an opportunity to obtain a visa free of charge,

- the possibility of establishing and running a business on the same terms as Polish citizens,

- exemption from the obligation to have a work permit,

- a discount on rail travel,

- the possibility of applying for a permanent residence permit in the Republic of Poland and a cash benefit intended to partially cover the costs of settlement and current maintenance in Poland,

- exemption from the fee for issuing a permanent residence permit,

- access to emergency healthcare services.

Regardless of where the application is submitted, certain requirements must be met to obtain the Pole's Card. People who declare their belonging to the Polish nation, demonstrate at least basic knowledge of the Polish language and knowledge of Polish culture, traditions and customs, submit a declaration that neither they nor their ancestors have repatriated or were repatriated from the territory of the Republic of Poland or the Polish People's Republic on the basis of appropriate repatriation agreements concluded in the years 1944-1957 and meet one of the following conditions are eligible to obtain the Pole’s Card:

- are of Polish nationality or at least one of their parents or grandparents or two great-grandparents are/were of Polish nationality,

- present a certificate from a Polish or Polish diaspora organization confirming active involvement in activities for the benefit of Polish language and culture or the Polish national minority for a period of at least the last three years.

If you wish to submit an application for the Pole's Card on the territory Poland, it is worth to first check the details regarding the registration for submitting the application, the procedure and the number of copies of the required documents on the website of the voivodship office competent for your place of residence, as these procedures may differ in individual voivodships. Both the examination of the application for the Pole's Card and the obtaining of the card itself are free of charge. As a rule, the Pole's Card is issued for a period of 10 years; in the case of minors (for the issuance of the Pole's Card for whom parents apply), this period is also 10 years, but no longer than until the day on which one year has passed since the minor has attained the age of majority. On the other hand, for people who are at least 65 years of age at the time of issue of the card, it is issued for an indefinite period.

Громадяни України (а також громадяни Республіки Білорусь та Російської Федерації або особи, які мають статус осіб без громадянства в одній із цих трьох держав) мають можливість оформити Карту Поляка на території Польщі відповідно до постанови Ради Міністрів від 1 липня 2022 року, якою внесено зміни до постанови щодо визначення воєводи, відповідального за розгляд заяв про надання або продовження терміну дії Карти Поляка. Це означає, що наразі громадяни України можуть подати заяву на отримання або обмін Карти Поляка двома способами: у відповідному Консульстві Республіки Польща або в воєводському управлінні та його відділенях, відповідно до місця проживання в Польщі. Карта Поляка — це документ, що засвідчує належність особи до польського народу. Важливо зазначити, що Карта Поляка не є еквівалентом дозволу на проживання (так званої карти перебування) і не прирівнюється до польського громадянства. Отже, сама по собі вона не надає права на законне перебування на території Республіки Польща та не дає підстав для перетину державного кордону. Водночас Карта Поляка надає низку інших прав, зокрема: 

• можливість отримання безкоштовної візи; 

• право на відкриття та ведення підприємницької діяльності на тих самих умовах, що й громадяни Польщі; 

• звільнення від обов’язку отримання дозволу на роботу; 

• знижки на проїзд залізницею; 

• можливість подання заяви на отримання дозволу на постійне проживання в Республіці Польща, а також фінансової допомоги для часткового покриття витрат на облаштування та поточне утримання в Польщі; 

• звільнення від сплати збору за надання дозволу на постійне проживання; 

• доступ до медичної допомоги у разі невідкладних станів. 

Незалежно від місця подання заяви, для отримання Карти Поляка необхідно відповідати визначеним вимогам. Право на отримання Карти Поляка мають особи, які: заявляють про свою належність до польського народу, володіють польською мовою щонайменше на базовому рівні,  знають польську культуру, традиції та звичаї, подадуть письмову заяву про те, що ні вони, ні їхні предки не здійснювали репатріацію або не були репатрійовані з території Республіки Польща чи Польської Народної Республіки на підставі відповідних угод про репатріацію, укладених у 1944–1957 роках, а також відповідають одному з наступних критеріїв: 

• мають польську національність або щонайменше один із батьків, один із дідусів чи бабусь, або двоє прадідів мали або мають польську національність; 

• нададуть довідку від польської або полонійної організації, що підтверджує їхню активну участь у діяльності, спрямованій на підтримку польської мови, культури або польської національної меншини, протягом щонайменше останніх трьох років. 

У разі наміру подати заяву на отримання Карти Поляка на території Польщі рекомендується попередньо ознайомитися з інформацією щодо порядку реєстрації на подання заяви, процедури її розгляду, а також кількості необхідних примірників документів на офіційному сайті відповідного воєводського управління за місцем проживання. Це важливо, оскільки процедура може відрізнятися залежно від воєводства. Розгляд заяви на отримання Карти Поляка, а також видача самого документа здійснюються безкоштовно. Як правило, Карта Поляка видається строком на 10 років. Для осіб, які не досягли повноліття (за яких заяву подають батьки), вона також дійсна протягом 10 років, але не довше, ніж до дня, коли мине рік з моменту досягнення повноліття. Особи, які на момент видачі Карти Поляка досягли 65-річного віку, отримують її безстроково.
