Holders of the \"UKR\" status (PESEL number with the \"UKR\" status), or more precisely, beneficiaries of temporary protection in Poland under the terms of the so-called Ukrainian special act, i.e. the Act of 12 March 2022 on assistance to citizens of Ukraine in connection with the armed conflict on the territory of that country (consolidated text: Journal of Laws 2024.167), often wonder what benefits they are entitled to and until when they are entitled to these benefits. Focusing on social assistance benefits - this entitlement is regulated in Article 29 of the so-called Ukrainian special act. Therefore, if you have the \"UKR status\", you may be granted cash or non-cash benefits if you have legal residence in Poland under the terms of temporary protection. Currently, the stay of Ukrainian citizens with the status of \"UKR\" is considered legal until September 30, 2025 (legal status as of February 17, 2025). Therefore, you can apply for social assistance benefits until that date. However, you should bear in mind any hypothetical statutory changes in this area, which may, for example, extend the period of legal stay under the principles of temporary protection, and thus the entitlement to social assistance benefits.<\/p>
If you already know that you are eligible to apply for these benefits, where should you go? Depending on your place of residence, it might be appropriate to visit one of the Municipal Social Welfare Centers (GOPS), the Urban Social Welfare Centers (MOPS) or the Urban Family Assistance Centers (MOPR).<\/p>
When applying for a social assistance benefit, you must submit a written application along with the required documents that are necessary when applying for a specific benefit. Usually, the relevant offices have sample application forms to fill out. After the procedure has been conducted, an administrative decision is issued, which may be positive for you (you will be granted the right to the benefit) or negative (the office will deny you the right to the benefit). In the case of the latter decision, remember that you have the right to appeal against it within 14 days of receiving it. The appeal must be submitted in writing and must be justified, i.e. you must indicate why you do not agree with the decision. In the part of the decision called \"Instructions\" (remember to always read them carefully, even if the decision is positive), you will find information about which authority to appeal to and through whom.<\/p>
The issue of permanent allowance is regulated, among others, by Article 37 of the Act of 12 March 2004 on social assistance (consolidated text: Journal of Laws 2024.128). If you are an adult who meets the above-mentioned criteria and:<\/p>
- you are unable to work due to age (you have reached retirement age, i.e. at least 60 years for women and at least 65 years for men), or you are completely unable to work (you have, among other things, a certificate of significant or moderate degree of disability or a certificate from a ZUS medical expert of complete incapacity for work) and:<\/p>
- you are a single person, i.e. you run a one-person household, you can receive a permanent benefit if your income is lower than the income criterion established for a single person (currently PLN 1,010), or in the case where:<\/p>
- you are a person remaining in a family (you run a household together with your family), you can receive a permanent benefit if your income and the income per person in the family is lower than the income criterion established per person in the family (currently PLN 823).<\/p>
As you can see, depending on whether you run a single-person or multi-person household, the way in which you meet the requirement of having a lower income than the established income criterion will be determined differently.<\/p>
What can the benefit amount to then? The permanent benefit value cannot exceed 1229 z\u0142 monthly, while at the same time, the minimum amount cannot be lower than 100 z\u0142.<\/p>
In the first case, the amount of the permanent benefit will be determined based on the difference between the amount constituting 130% of the income criterion (i.e. 130% x PLN 1,010) and your income. In the second case, it will be the difference between the amount constituting the income criterion (130% x PLN 823) and the income per person in your family.<\/p>
Remember that there are also exceptions when you will not be entitled to the permanent benefit. This applies to situations where your entitlement to the permanent allowance coincides with another benefit such as, among others, care allowance, special care allowance or single parenting allowance.<\/p>
Keep in mind that the relevant office may conduct a family social interview with you in order to determine your personal, family, economic and property situation, and may also request that you submit documents, such as those confirming the amount of your income.<\/p>
