Strze\u017cone o\u015brodki dla cudzoziemc\u00f3w, zwane r\u00f3wnie\u017c o\u015brodkami zamkni\u0119tymi, s\u0105 plac\u00f3wkami nadzorowanymi przez Stra\u017c Graniczn\u0105 (SG). W Polsce funkcjonuje sze\u015b\u0107 takich o\u015brodk\u00f3w, kt\u00f3re \u0142\u0105cznie mog\u0105 pomie\u015bci\u0107 1200 os\u00f3b.&nbsp;<\/p><p class=\"wp-block-paragraph\">W stosunku do cudzoziemc\u00f3w detencja mo\u017ce by\u0107 stosowana w celu zapewnienia bezpiecze\u0144stwa poprzez zapobieganie nielegalnemu wjazdowi lub pobytowi na terytorium kraju, przygotowania do deportacji, co umo\u017cliwia organom pa\u0144stwowym przeprowadzenie procedur deportacyjnych, oraz weryfikacji to\u017csamo\u015bci, kt\u00f3ra pozwala na ustalenie to\u017csamo\u015bci oraz statusu imigracyjnego zatrzymanej osoby. W strze\u017conym o\u015brodku mo\u017ce by\u0107 umieszczony ma\u0142oletni cudzoziemiec bez opieki, kt\u00f3ry uko\u0144czy\u0142 15. rok \u017cycia. przebywaj\u0105cy na terytorium Rzeczypospolitej Polskiej.&nbsp;&nbsp;<\/p><p class=\"wp-block-paragraph\">Przes\u0142anki, dla kt\u00f3rych cudzoziemcy mog\u0105 by\u0107 umieszczani w strze\u017conym o\u015brodku, s\u0105 uregulowane w ustawie o udzielaniu cudzoziemcom ochrony na terytorium RP oraz w ustawie o cudzoziemcach. Nale\u017cy podkre\u015bli\u0107, \u017ce zastosowanie detencji powinno by\u0107 traktowane jako \u015brodek ostateczny, stosowany wy\u0142\u0105cznie w sytuacjach, gdy nie jest mo\u017cliwe zastosowanie alternatywnych \u015brodk\u00f3w wobec detencji takich jak regularne zg\u0142aszanie si\u0119 do SG, wniesienie zabezpieczenia finansowego, zamieszkiwanie w wyznaczonym miejscu lub przekazanie dokumentu podr\u00f3\u017cy do depozytu.&nbsp;<\/p><p class=\"wp-block-paragraph\">Pierwsze zatrzymanie cudzoziemca przez Stra\u017c Graniczn\u0105 trwa maksymalnie 48 godzin, podczas kt\u00f3rych SG sk\u0142ada do s\u0105du wniosek o umieszczenie cudzoziemca w strze\u017conym o\u015brodku. S\u0105d, po rozpatrzeniu wniosku, mo\u017ce wyda\u0107 decyzj\u0119 o umieszczeniu cudzoziemca w strze\u017conym o\u015brodku na okres:&nbsp;<\/p><ol start=\"1\" class=\"wp-block-list\"><li>do 60 dni, w przypadku, gdy cudzoziemiec z\u0142o\u017cy\u0142 wniosek o udzielenie ochrony mi\u0119dzynarodowej,&nbsp;&nbsp;<\/li><\/ol><ol start=\"2\" class=\"wp-block-list\"><li>do 90 dni, w przypadku, gdy cudzoziemiec nie z\u0142o\u017cy\u0142 wniosku o udzielenie ochrony mi\u0119dzynarodowej.&nbsp;<\/li><\/ol><p class=\"wp-block-paragraph\">Zale\u017cnie od indywidualnej sytuacji cudzoziemca, okres pobytu w o\u015brodku mo\u017ce by\u0107 przed\u0142u\u017cany. Maksymalny dopuszczalny \u0142\u0105czny czas pobytu cudzoziemca w detencji to 18 miesi\u0119cy. Po 6 miesi\u0105cach od z\u0142o\u017cenia wniosku o udzielenie ochrony, je\u017celi nie wydano decyzji negatywnej w II instancji, cudzoziemca zwalnia si\u0119 z o\u015brodka zamkni\u0119tego.&nbsp;<\/p><p class=\"wp-block-paragraph\">Cudzoziemcy przebywaj\u0105cy w o\u015brodkach maj\u0105 prawo do zapoznania si\u0119 z przys\u0142uguj\u0105cymi im prawami i obowi\u0105zkami, a tak\u017ce do bezp\u0142atnej pomocy prawnej i j\u0119zykowej w sprawach administracyjnych i zdrowotnych. Ponadto, cudzoziemcom przys\u0142uguje prawo do wnoszenia za\u017cale\u0144 na postanowienie o umieszczeniu w strze\u017conym o\u015brodku, przed\u0142u\u017ceniu pobytu w o\u015brodku oraz na decyzj\u0119 Stra\u017cy Granicznej o odmowie zwolnienia ze strze\u017conego o\u015brodka lub aresztu dla cudzoziemc\u00f3w. Za\u017calenie wnosi si\u0119 w terminie 7 dni liczonymi od dnia dostarczenia postanowienia za po\u015brednictwem Stra\u017cy Granicznej do s\u0105du rejonowego w\u0142a\u015bciwego ze wzgl\u0119du na siedzib\u0119 organu SG, kt\u00f3remu podlega strze\u017cony o\u015brodek lub areszt dla cudzoziemc\u00f3w. SG niezw\u0142ocznie przekazuje za\u017calenie do s\u0105du rejonowego. S\u0105d rozpoznaje za\u017calenie w terminie 7 dni.&nbsp;<\/p><p class=\"wp-block-paragraph\">&nbsp;Co wi\u0119cej Cudzoziemcowi przys\u0142uguje odszkodowanie oraz zado\u015b\u0107uczynienie od Skarbu Pa\u0144stwa w sytuacji, gdy jego zatrzymanie, umieszczenie w strze\u017conym o\u015brodku lub decyzja o areszcie dla cudzoziemc\u00f3w oka\u017c\u0105 si\u0119 nies\u0142uszne.&nbsp;<\/p><p class=\"wp-block-paragraph\">Postanowienie o zwolnieniu cudzoziemca ze strze\u017conego o\u015brodka lub z aresztu dla cudzoziemc\u00f3w jest wydawane niezw\u0142ocznie przez organ Stra\u017cy Granicznej, kt\u00f3ry zarz\u0105dza danym o\u015brodkiem lub aresztem, z urz\u0119du lub na wniosek cudzoziemca, w przypadku:&nbsp;<\/p><ol start=\"1\" class=\"wp-block-list\"><li>ustania przyczyn, kt\u00f3re uzasadnia\u0142y zastosowanie tych \u015brodk\u00f3w;&nbsp;<\/li><\/ol><ol start=\"2\" class=\"wp-block-list\"><li>gdy postanowienie o umieszczeniu cudzoziemca w strze\u017conym o\u015brodku lub o zastosowaniu wobec niego aresztu:&nbsp;<\/li><\/ol><ul class=\"wp-block-list\"><li>mog\u0142oby stanowi\u0107 zagro\u017cenie dla \u017cycia lub zdrowia cudzoziemca,&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>stan psychofizyczny cudzoziemca sugeruje, \u017ce m\u00f3g\u0142 by\u0107 on ofiar\u0105 przemocy;&nbsp;<\/li><\/ul><ol start=\"3\" class=\"wp-block-list\"><li>gdy istniej\u0105 inne okoliczno\u015bci uniemo\u017cliwiaj\u0105ce stosowanie tych \u015brodk\u00f3w;&nbsp;<\/li><\/ol><ol start=\"4\" class=\"wp-block-list\"><li>wydania za\u015bwiadczenia, \u017ce cudzoziemiec jest ofiar\u0105 handlu lud\u017ami lub toczy si\u0119 post\u0119powanie w sprawie wydania zezwolenia na pobyt czasowy dla ofiar handlu lud\u017ami;&nbsp;<\/li><\/ol><ol start=\"5\" class=\"wp-block-list\"><li>zastosowania wobec cudzoziemca tymczasowego aresztowania lub innego \u015brodka prawnego, kt\u00f3ry skutkuje pozbawieniem wolno\u015bci;&nbsp;<\/li><\/ol><ol start=\"6\" class=\"wp-block-list\"><li>gdy istnieje znikome prawdopodobie\u0144stwo wykonania decyzji o zobowi\u0105zaniu cudzoziemca do powrotu ze wzgl\u0119d\u00f3w prawnych lub faktycznych.&nbsp;<\/li><\/ol><p class=\"wp-block-paragraph\">UA<\/p><p class=\"wp-block-paragraph\">\u0414\u0435\u0442\u0435\u043d\u0446\u0456\u044f, foreigners subject to the refugee procedure.<\/p><p class=\"wp-block-paragraph\">Detention, so the placement of a foreigner in a guarded centre for foreigners is a form of administrative confinement. The guarded centres for foreigners, also known as closed centres, are facilities overseen by the Border Guard (SG). There are six such centres in Poland, which can accommodate a total of 1,200 people.<\/p><p class=\"wp-block-paragraph\">When it comes to foreigners, detention may be used for the purpose of maintaining safety by preventing illegal entry or stay in the territory of Poland, preparation for deportation, which allows the state authorities to carry out the deportation procedure effectively, and for the purpose of identity verification, that allows the authorities to establish the migration status of the detained individual. A minor foreigner over the age of 15, staying in Poland without protection, may be placed in a closed centre.<\/p><p class=\"wp-block-paragraph\">The reasons for which foreigners may be placed in a guarded centre are established in the Act on Granting Foreigners Protection on the Territory of the Republic of Poland as well as the Act on Foreigners. It is important to note that applying detention should be treated as a last resort option, used only when all alternative avenues of action were exhausted, those being making regular appearances at the SG office, providing a monetary deposit, living in a designated area or providing the SG with your travel document as a deposit.<\/p><p class=\"wp-block-paragraph\">The initial detention of a foreigner by the Border Guard may last a maximum of 48 hours, during which the SG submits an application to the court for a decision to place the foreigner in a guarded centre. After reviewing the application, the court may issue a decision to place the foreigner in a closed centre for a period of:<\/p><p class=\"wp-block-paragraph\">1. Up to 60 days, in the case of a foreigner who had submitted the application for international protection,<\/p><p class=\"wp-block-paragraph\">2. Up to 90 days, in the case of a foreigner who did not submit an application for international protection.<\/p><p class=\"wp-block-paragraph\">Depending on the individual situation of a foreigner, the period of stay at a closed centre may be extended. The maximum permissible period of detention amounts to 18 months in total. After 6 months from the moment of submission of the application for international protection, if a negative decision was not taken by the court of the II instance, the foreigner is then released from the closed centre.<\/p><p class=\"wp-block-paragraph\">Foreigners staying in the centers have the right to familiarize themselves with their rights and obligations, as well as to free legal and language assistance in administrative and health matters. In addition, foreigners have the right to file complaints against the decision to<\/p><p class=\"wp-block-paragraph\">place them in a guarded center, extend their stay in the center, and against the decision of the Border Guard to refuse release from a guarded center or arrest for foreigners. The complaint must be filed within 7 days from the date of delivery of the decision through the Border Guard to the regional court with jurisdiction over the seat of the Border Guard body to which the guarded center or detention center for foreigners is subordinate. The Border Guard immediately forwards the complaint to the regional court. The court examines the complaint within 7 days.<\/p><p class=\"wp-block-paragraph\">Moreover every foreigner has the right to compensation and damages from the State Treasury in cases when their detention, placement in a closed centre or decision on arrest for foreigners turns out to be unjust.<\/p><p class=\"wp-block-paragraph\">A decision to release a foreigner from a guarded centre or an arrest for foreigners is issued immediately by the Border Guard authority managing the given centre or detention centre, ex officio or at the request of the foreigner, in the event when:<\/p><p class=\"wp-block-paragraph\">1. the reasons that justified the application of these measures have ceased to exist;<\/p><p class=\"wp-block-paragraph\">2. a decision on placing the foreigner in a guarded centre or to place them under arrest:<\/p><p class=\"wp-block-paragraph\">&#8211; could be a threat to the life or well-being of the foreigner,<\/p><p class=\"wp-block-paragraph\">&#8211; the psycho-physical state of the foreigner suggests that they could have been a victim of violence;<\/p><p class=\"wp-block-paragraph\">3. there are other circumstances that prevent the use of these measures;<\/p><p class=\"wp-block-paragraph\">4. it was verified that the foreigner was a victim of human trafficking or a procedure on granting temporary stay to a victim of human trafficking is currently ongoing in regards to them;<\/p><p class=\"wp-block-paragraph\">5. a foreigner has been placed under temporary arrest or has been subjected to another legal measure that results in deprivation of liberty;<\/p><p class=\"wp-block-paragraph\">6. the fulfilment of the decision on the obligation to return the foreigner to their home country is improbable due to legal or factual circumstances.<\/p><p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>Detencja, czyli umieszczenie cudzoziemca w strze\u017conym o\u015brodku dla cudzoziemc\u00f3w, jest form\u0105 administracyjnego zatrzymania.
