Post\u0119powanie o zobowi\u0105zanie do powrotu jest form\u0105 post\u0119powania administracyjnego prowadzonego wobec cudzoziemca przebywaj\u0105cego na terytorium pa\u0144stwa, kt\u00f3ry nie spe\u0142nia lub przesta\u0142 spe\u0142nia\u0107 warunki legalnego pobytu, b\u0105d\u017a kt\u00f3rego obecno\u015b\u0107 z innych wzgl\u0119d\u00f3w zosta\u0142a uznana za niepo\u017c\u0105dan\u0105. Deportacja (wydalenie) oznacza przymusowe usuni\u0119cie cudzoziemca z terytorium pa\u0144stwa. Zobowi\u0105zanie do powrotu stanowi \u015brodek administracyjno-prawny o charakterze indywidualnym.<\/p>
Cudzoziemiec obowi\u0105zany jest opu\u015bci\u0107 terytorium Rzeczypospolitej Polskiej przed up\u0142ywem okresu pobytu okre\u015blonego w wydanej mu wizie Schengen lub wizie krajowej, a tak\u017ce przed up\u0142ywem okresu wa\u017cno\u015bci tej wizy. Obowi\u0105zek ten dotyczy r\u00f3wnie\u017c os\u00f3b, kt\u00f3re utraci\u0142y prawo do pobytu wynikaj\u0105ce z zezwole\u0144 udzielonych im przez inne pa\u0144stwa stosuj\u0105ce dyrektyw\u0119 Parlamentu Europejskiego i Rady 2008\/115\/WE z dnia 16 grudnia 2008 r. (art. 299 ust. 1a). W takim przypadku cudzoziemiec powinien niezw\u0142ocznie uda\u0107 si\u0119 na terytorium pa\u0144stwa, kt\u00f3re udzieli\u0142o mu stosownego zezwolenia pobytowego. Analogiczne zasady stosuje si\u0119 wobec cudzoziemc\u00f3w korzystaj\u0105cych z re\u017cimu ruchu bezwizowego, zar\u00f3wno na podstawie um\u00f3w mi\u0119dzynarodowych, jak i jednostronnego zniesienia obowi\u0105zku wizowego. Przepisy precyzuj\u0105 maksymalny dopuszczalny czas pobytu oraz wskazuj\u0105, od kiedy nale\u017cy liczy\u0107 terminy wyjazdu w sytuacji zmiany statusu prawnego danego re\u017cimu.<\/p>
W decyzji o zobowi\u0105zaniu cudzoziemca do powrotu co do zasady orzeka si\u0119 zakaz ponownego wjazdu na terytorium RP i pa\u0144stw Schengen, ale mo\u017cna od tego odst\u0105pi\u0107, je\u015bli istnieje wysokie prawdopodobie\u0144stwo, \u017ce cudzoziemiec b\u0119dzie przestrzega\u0142 prawa. Nie mo\u017cna odst\u0105pi\u0107 od zakazu, je\u017celi w ci\u0105gu ostatnich dw\u00f3ch lat Stra\u017c Graniczna ju\u017c raz odst\u0105pi\u0142a od jego wydania wobec danego cudzoziemca.<\/p>
Je\u015bli organ administracyjny wyda decyzj\u0119 zobowi\u0105zuj\u0105c\u0105 cudzoziemca do powrotu, organ ten ma obowi\u0105zek zapewni\u0107 jej t\u0142umaczenie. Je\u017celi cudzoziemiec nie zna wystarczaj\u0105co dobrze j\u0119zyka polskiego, ma prawo korzysta\u0107 z pomocy t\u0142umacza w trakcie ca\u0142ego post\u0119powania. Samo rozstrzygni\u0119cie, a tak\u017ce pouczenie o \u015brodkach odwo\u0142awczych, musi zosta\u0107 przet\u0142umaczone cudzoziemcowi ustnie lub pisemnie na j\u0119zyk, kt\u00f3ry rozumie. Dodatkowo organ prowadz\u0105cy post\u0119powanie ma obowi\u0105zek poinformowa\u0107 cudzoziemca o mo\u017cliwo\u015bci uzyskania pomocy, zw\u0142aszcza prawnej, od organizacji pozarz\u0105dowych zajmuj\u0105cych si\u0119 cudzoziemcami.<\/p>
Je\u017celi cudzoziemiec nie opu\u015bci Polski dobrowolnie w wyznaczonym terminie, decyzja o zobowi\u0105zaniu do powrotu podlega przymusowemu wykonaniu przez Stra\u017c Graniczn\u0105. Przymusowe wykonanie mo\u017ce nast\u0105pi\u0107 r\u00f3wnie\u017c wtedy, gdy organ nie wyznaczy\u0142 terminu dobrowolnego wyjazdu, a istnieje uzasadnione ryzyko, \u017ce cudzoziemiec mo\u017ce pr\u00f3bowa\u0107 si\u0119 ukry\u0107, lub gdy jego dalszy pobyt m\u00f3g\u0142by zagra\u017ca\u0107 obronno\u015bci, bezpiecze\u0144stwu pa\u0144stwa, porz\u0105dkowi publicznemu. Przymusowe wykonanie polega na doprowadzeniu cudzoziemca do granicy, lotniska albo portu morskiego w pa\u0144stwie, do kt\u00f3rego zostaje przekazany. Je\u017celi przelot lub transport odbywa si\u0119 z terytorium Polski do innego pa\u0144stwa, stosuje si\u0119 w tym zakresie przepisy Unii Europejskiej dotycz\u0105ce organizacji wsp\u00f3lnych powrot\u00f3w.<\/p>
Od decyzji w sprawie zobowi\u0105zania do powrotu odwo\u0142anie wnosi si\u0119 za po\u015brednictwem organu, kt\u00f3ry wyda\u0142 zaskar\u017can\u0105 decyzj\u0119, do organu wy\u017cszego stopnia w terminie 7 dni od dor\u0119czenia decyzji. Od ostatecznej decyzji przys\u0142uguje skarga do Wojew\u00f3dzkiego S\u0105du Administracyjnego, kt\u00f3r\u0105 nale\u017cy wnie\u015b\u0107 w terminie 30 dni od dnia dor\u0119czenia decyzji ostatecznej. Wniesienie skargi nie zawsze wstrzymuje wykonanie decyzji (chyba \u017ce s\u0105d postanowi inaczej).<\/p>

Proceeding for the obligation to return is a form of administrative <\/strong>procedure conducted against a foreign national residing in the territory of a country who does not meet or no longer meets the conditions for legal residence, or whose presence has been deemed undesirable for other reasons. Deportation (expulsion) means the forced removal of a foreigner from the territory of the state. An obligation to return constitutes an individual administrative and legal measure. <\/p> A foreigner is obliged to leave the territory of Poland before the expiry of the period of stay to which he is entitled on the basis of a Schengen visa or a national visa, and before the expiry of such a visa. The obligation also applies to the individual who have lost their right of residence driven from permits granted to them by other countries applying the Directive 2008\/115\/EC of the European Parliament and of the Council of 16 December 2008 Article 299, paragraph 1a). In such circumstances, the foreign national should promptly proceed to the territory of the state that granted the residence permit. Similar rules apply to foreigners benefiting from the visa-free travel regime, both on the basis of international agreements and unilateral waiver of the visa requirement. The regulations specify the maximum permissible duration of a stay and indicate the date from which departure deadlines shall be calculated in the event of a change in the legal status of the given regime. <\/p> As a general rule, in a decision obliging a foreign national to return, a prohibition on re-entry into the territory of the Republic of Poland and the Schengen States, shall be imposed; however, such prohibition may be waived if there is every prospect that the foreign national will respect the law. Such prohibition may not be waived if, within the preceding two years, the Border Guard has already refrained from imposing such a prohibition on that foreigner. <\/p> If an administrative board issues a decision charging a foreign national to return, such authority is obliged to ensure the translation of the decision. If the foreigner is not fluent enough in the Polish language, they shall have the right to the assistance of an interpreter throughout the entire proceedings. The decision itself, as well as the information regarding means of appeal must be translated to the foreign national either orally or in writing into a language which they understand. In addition, the authority conducting the proceedings is obliged to inform the foreigner of the possibility of obtaining assistance, particularly legal assistance, from non-governmental organizations dealing with foreign nationals. <\/p> If a foreigner does not leave Poland voluntarily within the specified time limit, the decision to oblige them to return is subject to enforcement by the Border Guard. Compulsory enforcement may also take place if the authority has not set a deadline for voluntary departure and there is a reasonable risk that the foreigner may attempt to hide, or if their continued stay could threaten national defense, state security, or public order. Compulsory enforcement consists in escorting the foreigner to the border, an airport, or a seaport in the country to which they are being transferred. If the flight or transport takes place from the territory of Poland to another country, the European Union regulations concerning the organization of joint return operations apply. <\/p> An appeal against a decision on the obligation to return must be submitted, through the authority that issued the contested decision, to the higher-level authority within 7 days from the date of delivery of the decision. A complaint against the final decision may be filed with the Voivodeship Administrative Court, and must be submitted within 30 days from the date of delivery of the final decision.
