Nowe rozporz\u0105dzenie w swojej tre\u015bci&nbsp;jest do\u015b\u0107 podobne do poprzedniego. Nie mniej, je\u017celi cudzoziemiec by\u0142 zwolniony z obowi\u0105zku&nbsp;posiadania zezwolenia na mocy poprzedniego rozporz\u0105dzenia, za\u015b nowe rozporz\u0105dzenie ju\u017c nie&nbsp;przewiduje takiej okoliczno\u015bci, nie oznacza to, \u017ce praca tego cudzoziemca z dnia na dzie\u0144 sta\u0142a si\u0119&nbsp;nielegalna, bowiem mo\u017ce on kontynuowa\u0107 prac\u0119 bez zezwolenia lub bez o\u015bwiadczenia na zasadach&nbsp;dotychczasowych jeszcze do maja 2026 roku.&nbsp;<\/p><p class=\"wp-block-paragraph\"><strong>Rozporz\u0105dzenie Ministra Rodziny, Pracy i Polityki Spo\u0142ecznej z dnia 21 listopada 2025 r. w sprawie&nbsp;<\/strong><strong>pa\u0144stw, kt\u00f3rych obywateli mog\u0105 dotyczy\u0107 o\u015bwiadczenia o powierzeniu pracy cudzoziemcowi oraz&nbsp;<\/strong><strong>niekt\u00f3re przepisy dotycz\u0105ce zezwolenia na prac\u0119 sezonow\u0105&nbsp;<\/strong><\/p><p class=\"wp-block-paragraph\">Tak zwana procedura o\u015bwiadczeniowa, czyli mo\u017cliwo\u015b\u0107 zatrudnienia cudzoziemc\u00f3w na&nbsp;uproszczonych zasadach, pierwotnie dotyczy\u0142a obywateli sze\u015bciu pa\u0144stw: Armenii, Bia\u0142orusi, Gruzji,&nbsp;Mo\u0142dawii, Ukrainy oraz Rosji. W 2022 r., po pe\u0142noskalowej agresji Rosji na Ukrain\u0119, Rosja zosta\u0142a&nbsp;wykre\u015blona z tej listy, za\u015b nowe rozporz\u0105dzenie wykre\u015bla z tej listy r\u00f3wnie\u017c i Gruzj\u0119, co oznacza, \u017ce z&nbsp;dniem 1 grudnia 2025 roku pracodawcy nie mog\u0105 ju\u017c rejestrowa\u0107 nowych o\u015bwiadcze\u0144 dla obywateli&nbsp;Gruzji.&nbsp;<\/p><p class=\"wp-block-paragraph\"><strong>Projekt ustawy z 21 listopada 2025 r. o zmianie ustawy o cudzoziemcach oraz niekt\u00f3rych innych&nbsp;<\/strong><strong>ustaw&nbsp;<\/strong><\/p><p class=\"wp-block-paragraph\">Na chwil\u0119 obecn\u0105 nie m\u00f3wimy o obowi\u0105zuj\u0105cym akcie prawnym, lecz jeszcze o jego&nbsp;projekcie, ale wydaje si\u0119, \u017ce ze wzgl\u0119du na zaawansowany poziom prac (ustawa zosta\u0142a ju\u017c&nbsp;uchwalona przez obie izby polskiego parlamentu i czeka wy\u0142\u0105cznie na podpis Prezydenta RP) oraz&nbsp;wag\u0119 tematu, jest prawie pewne, \u017ce dost\u0119pny tekst aktu prawnego zostanie zaakceptowany przez&nbsp;Prezydenta i wejdzie w \u017cycie na pocz\u0105tku 2026 r.&nbsp;<\/p><p class=\"wp-block-paragraph\">Omawiany projekt ustawy z 21 listopada 2025 r. o zmianie ustawy o cudzoziemcach oraz&nbsp;niekt\u00f3rych innych ustaw zak\u0142ada m.in. wprowadzenie nowego sposobu sk\u0142adania wniosk\u00f3w o&nbsp;udzielenie zezwole\u0144 na pobyt czasowy, sta\u0142y oraz pobyt rezydenta d\u0142ugoterminowego UE, a tak\u017ce&nbsp;wymaganych za\u0142\u0105cznik\u00f3w do tych wniosk\u00f3w. Zamiast obowi\u0105zkowej wizyty w urz\u0119dzie wojew\u00f3dzkim&nbsp;i papierowej formy wniosku, cudzoziemcy b\u0119d\u0105 sk\u0142ada\u0107 dokumenty elektronicznie za po\u015brednictwem&nbsp;systemu teleinformatycznego \u201eModu\u0142 Obs\u0142ugi Spraw\u201d (tzw. MOS). System prowadzony przez Szefa Urz\u0119du ds. Cudzoziemc\u00f3w ju\u017c funkcjonuje i pozwala na elektroniczne uzupe\u0142nienie wniosku&nbsp;pobytowego (dotyczy wniosku o udzielenie zezwolenia na pobyt czasowy i pobyt sta\u0142y) oraz&nbsp;przes\u0142anie go do jednolitej bazy wniosk\u00f3w, po czym wniosek uzyskuje unikatowy numer oraz kod&nbsp;kreskowy u\u0142atwiaj\u0105cy jego identyfikacj\u0119 przez urz\u0119dy wojew\u00f3dzkie. Omawiana nowelizacja&nbsp;przewiduje wprowadzenie dodatkowej funkcjonalno\u015bci serwisu, tj. podpisanie (podpisem zaufanym&nbsp;lub kwalifikowanym podpisem elektronicznym) wniosku wraz ze wszystkimi wymaganymi&nbsp;za\u0142\u0105cznikami, a nast\u0119pnie ich z\u0142o\u017cenie w postaci elektronicznej bezpo\u015brednio do w\u0142a\u015bciwego&nbsp;wojewody (obecnie wszystkie te wnioski s\u0105 sk\u0142adane osobi\u015bcie, na urz\u0119dowych formularzach w&nbsp;formie papierowej).&nbsp;<\/p><p class=\"wp-block-paragraph\">W przypadku za\u0142\u0105cznik\u00f3w do wniosku o udzielenie zezwolenia na pobyt czasowy i prac\u0119 (w&nbsp;tym praca w zawodzie wymagaj\u0105cym wysokich kwalifikacji, mobilno\u015b\u0107 d\u0142ugoterminowa posiadacza&nbsp;Niebieskiej Karty UE, pobyt czasowy w celu prowadzenia dzia\u0142alno\u015bci gospodarczej), zezwolenia na&nbsp;pobyt czasowy dla sta\u017cysty lub wolontariusza oraz zezwolenia na pobyt czasowy w celu kszta\u0142cenia&nbsp;si\u0119 na studiach, na wskazany we wniosku adres poczty elektronicznej (odpowiednio pracodawcy,&nbsp;organizatora sta\u017cu\/wolontariatu albo jednostki prowadz\u0105cej studia) zostanie wys\u0142ana&nbsp;korespondencja z linkiem umo\u017cliwiaj\u0105cym wype\u0142nienie tych za\u0142\u0105cznik\u00f3w w MOS oraz ich podpisanie.&nbsp;<\/p><p class=\"wp-block-paragraph\">Pouczenie cudzoziemca o zasadach i trybie post\u0119powania oraz o przys\u0142uguj\u0105cych mu prawach&nbsp;i ci\u0105\u017c\u0105cych na nim obowi\u0105zkach (w j\u0119zyku dla niego zrozumia\u0142ym), kt\u00f3re na dzie\u0144 dzisiejszy s\u0105&nbsp;przekazywane w formie papierowej, z chwil\u0105 wej\u015bcia w \u017cycie omawianej nowelizacji b\u0119d\u0105&nbsp;udost\u0119pnione wy\u0142\u0105cznie w systemie teleinformatycznym MOS w postaci elektronicznej. System MOS jest systemem teleinformatycznym zarz\u0105dzanym przez Szefa Urz\u0119du ds.&nbsp;Cudzoziemc\u00f3w i zostanie udost\u0119pniony wszystkim osobom uprawnionym do sk\u0142adania wniosk\u00f3w \u2013&nbsp;cudzoziemcom, osobom dzia\u0142aj\u0105cym w imieniu ma\u0142oletnich, os\u00f3b ubezw\u0142asnowolnionych czy&nbsp;ma\u0142oletnich bez opieki.&nbsp;<\/p><p class=\"wp-block-paragraph\">Wprowadzenie obowi\u0105zku sk\u0142adania wniosk\u00f3w wy\u0142\u0105cznie w formie elektronicznej za&nbsp;po\u015brednictwem Modu\u0142u Obs\u0142ugi Spraw mo\u017ce jednak stanowi\u0107 wyzwanie dla cz\u0119\u015bci cudzoziemc\u00f3w,&nbsp;zw\u0142aszcza os\u00f3b starszych. Wielu z nich mo\u017ce mie\u0107 trudno\u015bci z obs\u0142ug\u0105 komputera, nie dysponowa\u0107&nbsp;odpowiednim sprz\u0119tem lub nie korzysta\u0107 z internetu. a&nbsp;rather specific&nbsp;and dynamically changing branch of law. Lawyers dealing with this subject have already become accustomed to the fact that changes in the broad sense of the law on foreigners occur quite often and are adopted hastily, but the last months of 2025 seem to be&nbsp;a real challenge&nbsp;given the number of regulatory acts being processed.&nbsp;Due to the pace of changes already introduced at the turn of November and December 2025, as well as considering the upcoming legislative amendments, information on this subject has been gathered in one place.&nbsp;<\/p><p class=\"wp-block-paragraph\"><strong>Regulation of the Minister of the Interior and Administration of 25 November 2025 on the application for the granting of a temporary residence permit to a foreign national.<\/strong>&nbsp;<\/p><p class=\"wp-block-paragraph\">The regulation, published on 28 November 2025 and which came into force on 1 December 2025, specifies, among other things, a new template for the application for the granting of a temporary residence permit to a foreign national, as well as new templates for the annexes to the application for the granting of a temporary residence permit. Although, in this respect, the regulation introduced only&nbsp;a number of&nbsp;very minor changes, it has caused some confusion in residence proceedings.&nbsp;<\/p><p class=\"wp-block-paragraph\">The implementing act was published just before the weekend (on Friday) and entered into force as early as Monday. Therefore, if a foreigner was preparing to submit an application in December, had collected all the required documents (completed, printed, and signed the residence application, and their employer completed Annex No. 1 to the residence application, etc.) and submitted this set of documents to the voivodeship office already in December, they have most likely already encountered certain complications or will learn about them soon (after receiving a letter from the office). The old application form and Annex No. 1 can no longer be used in residence proceedings. Consequently, in the situation described above, the foreigner will have to complete the residence application once again (using the current form), and their employer should issue a new annex to the foreigner.&nbsp;<\/p><p class=\"wp-block-paragraph\">It should be remembered that&nbsp;submitting&nbsp;an application on an incorrect form&nbsp;constitutes only&nbsp;a formal deficiency and is not a reason for an automatic refusal to consider the application. However, failure to remedy this deficiency within the prescribed time limit (as well as any other formal deficiencies) will result in a refusal to&nbsp;initiate&nbsp;the proceedings.&nbsp;<\/p><p class=\"wp-block-paragraph\">The regulation also specifies other issues, such as the number of photographs to be attached to the application (now only two photographs of the foreigner are required, not four as was previously the case), the rules for taking fingerprints, and the template for the stamp confirming the submission of the application, but these are purely technical changes and should not affect the proceedings initiated.&nbsp;<\/p><p class=\"wp-block-paragraph\"><strong>Regulation of the Minister of Family,&nbsp;Labour&nbsp;and Social Policy of 20 November 2025 on the amount of fees related to a work permit application and to a declaration on entrusting work to a foreigner<\/strong>&nbsp;<\/p><p class=\"wp-block-paragraph\">From December 1, 2025, the fees paid by employers wishing to hire a foreigner&nbsp;on the basis of&nbsp;a work permit or a declaration of entrusting work to a foreigner have changed. The new fees are as follows:&nbsp;<\/p><ul class=\"wp-block-list\"><li>PLN 200 \u2013 for a&nbsp;work&nbsp;permit issued for a period of up to 3 months (previously PLN 50);&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>PLN 400 \u2013 for a&nbsp;work&nbsp;permit issued for a period exceeding 3 months (previously PLN 100);&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>PLN 800 \u2013 for posting a foreigner to the territory of the Republic of Poland (previously PLN 200);&nbsp;&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>PLN 400 \u2013 for entering a declaration of entrusting work to a foreigner in the register of declarations (previously PLN 100);&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>PLN 100 \u2013 for a seasonal work permit (previously PLN 30).&nbsp;<\/li><\/ul><p class=\"wp-block-paragraph\"><strong>Regulation of the Minister of Family,&nbsp;Labour&nbsp;and Social Policy of 20 November 2025 on specific cases in which a foreigner entitled to stay in the territory of the Republic of Poland may perform work without a work permit or a declaration on entrusting work to a foreigner<\/strong>&nbsp;<\/p><p class=\"wp-block-paragraph\">The need to issue this regulation resulted from the entry into force on 1 June 2025 of a number of acts, including the Act of 20 March 2025 on the&nbsp;labour&nbsp;market and employment services (under which the Act of 20 April 2004 on the promotion of employment and&nbsp;labour&nbsp;market institutions was repealed), as well as the Act of 20 March 2025 on the conditions for the admissibility of entrusting work to foreigners in the territory of the Republic of Poland.&nbsp;<\/p><p class=\"wp-block-paragraph\">The implementing act replaces the Regulation of the Minister of&nbsp;Labour&nbsp;and Social Policy of 21 April 2015 on cases in which entrusting the performance of work to a foreigner in the territory of the Republic of Poland is permissible without the need to obtain a work permit, and it redefines a number of situations in which a foreigner entitled to stay in the territory of the Republic of Poland may perform work without the prior need to obtain a work permit or a declaration on entrusting work to a foreigner. The new regulation is, in its substance, quite&nbsp;similar to&nbsp;the&nbsp;previous&nbsp;one. Nevertheless, if a foreigner was exempt from the obligation to hold a work permit under the previous regulation, and the new regulation no longer provides for such a circumstance, this does not mean that the foreigner\u2019s work has suddenly become illegal, as they may continue to work without a permit or a declaration under the previous rules until May 2026.&nbsp;<\/p><p class=\"wp-block-paragraph\"><strong>Regulation of the Minister of Family,&nbsp;Labour&nbsp;and Social Policy of 21 November 2025 on the countries whose citizens may be covered by declarations on entrusting work to a foreigner and certain provisions concerning seasonal work permits<\/strong>&nbsp;<\/p><p class=\"wp-block-paragraph\">The so-called declaration procedure,&nbsp;i.e.&nbsp;the possibility of employing foreigners under simplified rules, originally applied to nationals of six countries: Armenia, Belarus, Georgia, Moldova, Ukraine, and Russia. In 2022, following Russia\u2019s full-scale aggression against Ukraine, Russia was removed from this list, and the new regulation also removes Georgia from the list. This means that as of 1 December 2025, employers can no longer register new declarations for citizens of Georgia.&nbsp;<\/p><p class=\"wp-block-paragraph\"><strong>Draft Act of 21 November 2025 amending the Act on Foreigners and certain other acts<\/strong>&nbsp;<\/p><p class=\"wp-block-paragraph\">At the moment, we are not talking about a binding legal act, but rather its draft. However, given the advanced stage of the work (the act has already been passed by both chambers of the Polish parliament and is only awaiting the signature of the President of the Republic of Poland) and the importance of the issue, it is almost certain that the text of the legal act will be approved by the President and will enter into force at the beginning of 2026.&nbsp;<\/p><p class=\"wp-block-paragraph\">The discussed draft Act of 21 November 2025 amending the Act on Foreigners and certain other acts provides, among other things, for the introduction of a new method for&nbsp;submitting&nbsp;applications for temporary residence permits, permanent residence permits, and EU long-term resident permits, as well as the required attachments to these applications. Instead of a mandatory visit to the voivodeship office and a paper application, foreigners will&nbsp;submitdocuments electronically via the IT system called the \u201cCase Handling Module\u201d (known as MOS). The system, managed by the Head of the Office for Foreigners, is already operational and allows for the electronic completion of residence applications (for temporary and permanent residence permits) and their submission to a unified application database. Once&nbsp;submitted, the application receives a unique number and a barcode to&nbsp;facilitate&nbsp;identification by the voivodeship offices. The proposed amendment provides for an&nbsp;additional&nbsp;functionality of the system: the ability to sign the application and all required attachments electronically (using a trusted signature or a qualified electronic signature) and then&nbsp;submit&nbsp;them electronically directly to the relevant voivode. Currently, all these applications must be&nbsp;submitted&nbsp;in person on official paper forms.&nbsp;<\/p><p class=\"wp-block-paragraph\">In the case of attachments to applications for a temporary residence and work permit (including work in a profession requiring high qualifications, long-term mobility of an EU Blue Card holder, or temporary residence for the purpose of running a business), a temporary residence permit for an intern or volunteer, or a temporary residence permit for study purposes, correspondence will be sent to the email address provided in the application (respectively, the employer, the internship\/volunteering organizer, or the educational institution). This correspondence will include a link allowing the recipient to complete these attachments in MOS and sign them electronically.&nbsp;<\/p><p class=\"wp-block-paragraph\">The information provided to the foreigner regarding the rules and procedures of the process, as well as their rights and obligations (in a language they understand), which is currently given in paper form, will, upon the entry into force of the discussed amendment, be made available exclusively in the MOS IT system in electronic form. The foreigner will be able to review this information while&nbsp;submitting&nbsp;the application online, and it will also be necessary to confirm, via MOS, that they have read and understood the information.&nbsp;<\/p><p class=\"wp-block-paragraph\">The proposed solutions respond to the growing number of cases related to residence legalization and to the changing needs of foreigners, who are increasingly using online services. The MOS system is an IT system managed by the Head of the Office for Foreigners and will be made available to all persons entitled to&nbsp;submit&nbsp;applications\u2014foreigners, individuals acting on behalf of minors, persons under legal incapacity, or unaccompanied minors.&nbsp;<\/p><p class=\"wp-block-paragraph\">However, introducing the obligation to&nbsp;submit&nbsp;applications exclusively in electronic form via the Case Handling Module may pose a challenge for some foreigners, especially older people. Many of them may have difficulty using a computer, may not have the&nbsp;appropriate equipment, or may not use the internet. As a result, they may need help from third parties or support at service points.&nbsp;<\/p><p class=\"wp-block-paragraph\">Additionally, other problems may arise, such as:&nbsp;<\/p><ul class=\"wp-block-list\"><li>language barriers hindering the correct completion of the online application,&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>the need to have a trusted profile or an electronic signature, which may be complicated for people less familiar with technology,&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>the risk of system overload during periods with a high number of&nbsp;submitted&nbsp;applications,&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>technical issues, such as an unstable internet connection or system errors, which may delay the process,&nbsp;<\/li><\/ul><ul class=\"wp-block-list\"><li>the&nbsp;need to attach digital copies of paper documents to&nbsp;applications, which&nbsp;requires a scanner or a phone capable of taking high-quality photos.&nbsp;<\/li><\/ul><p class=\"wp-block-paragraph\">Therefore, despite the&nbsp;numerous&nbsp;advantages of digitization, it will be important to provide adequate support to people who may have difficulty transitioning to the new, exclusively electronic method of&nbsp;submitting&nbsp;applications.&nbsp;In the event of&nbsp;a malfunction of the ICT system that prevents the submission of an application, the foreigner will be able to&nbsp;submit&nbsp;it no later than on the third working day after the malfunction has been rectified.&nbsp;<\/p><p class=\"wp-block-paragraph\">The draft also introduces a definition of the concept of a separated family member and thus partially clarifies the regulations (with regard to a temporary residence permit for the purpose of family reunification), and even introduces a new legal solution (with regard to a temporary residence permit for a family member of a Polish citizen or a citizen of an EU Member State) concerning the procedure for granting a temporary residence permit in a situation where the foreigner to whom the application relates is staying outside the borders of Poland, and the application for a temporary residence permit is submitted by a family member who already resides in the territory of Poland.&nbsp;<\/p><p class=\"wp-block-paragraph\">Until now, a foreigner could&nbsp;submit&nbsp;an application for a temporary residence permit for a family member of a Polish citizen or a citizen of an EU Member State in person to the competent provincial governor, which meant that a person outside the territory of Poland could not meet this requirement. The proposed solution provides that a member of a separated family (i.e., a citizen of Poland or a citizen of another EU Member State, EFTA, EEA, the Swiss Confederation, or the United Kingdom) residing in Poland will be able to apply for a temporary residence permit for a foreigner residing outside the Republic of Poland. As a result of the introduction of this solution, the procedure for legalizing residence in Poland may begin earlier, even before the foreigner obtains a visa or the possibility of entering the country. It should be emphasized that applications in these proceedings will continue to be&nbsp;submitted&nbsp;in paper form (not electronically) \u2013&nbsp;these&nbsp;will be the only residence proceedings that will remain in the \u201ctraditional\u201d procedure.&nbsp;<\/p><p class=\"wp-block-paragraph\">On the one hand, the introduction of the above solution will significantly shorten the period of separation and accelerate the process of family (re-)integration in Poland. On the other hand, it may lead to situations in which the likelihood of abuse increases, especially&nbsp;in the area of&nbsp;fictitious marriages contracted for money&nbsp;in order to&nbsp;obtain the right of residence.
