Obligations of foreigners to return

As part of the project “State – NGOs – Foreigners: Monitoring the implementation of statutory legal aid”, we sent an application for acess to public information to the Provincial Administrative Court in Warsaw.


In this application, we raised issues related to complaints against the decisions of the Head of the Office for Foreigners regarding the obligations of foreigners to return, submitted to the Provincial Administrative Court in Warsaw. We asked, inter alia, the number of complaints lodged, the number of applications for legal aid submitted by foreigners, or the number of refusals / granting such assistance.


According to the data received, the number of cases in which foreigners brought such a complaint was 113 in 2019, in 2020 – 192, and in 2021 – 168. One can notice a relatively low number of submitted applications for granting the right to legal aid in relation to the number of complaints lodged; 67 in 2019, in 2020 – 46, and in 2021 – only 33. We are still trying to reach as many foreigners as possible and gradually increase the awareness of their rights, in particular with regard to their appeal procedures.
