State – NGOs – Foreigners: Monitoring the implementation of statutory legal aid

 

The aim of the project is the monitoring of the application of public policy in the area of ensuring access to legal remedies for foreigners:

1) applying for granting international protection or

2) being in deportation proceedings.

The obligation to provide legal aid in both areas results from the European Union law. NGOs are the key entities to which Poland delegates these duties. The project, implemented in partnership with UNHCR, will strengthen organizations operating in an area treated with suspicion by politicians. It will also show the threats affecting the functioning of the entire sector, related to the refusal to finance the services indicated in the Act. A particularly important area of analysis will be to examine whether Poland has correctly implemented the Procedural Directive 2013/32 / EU and the Return Directive 2008/115 / EU in the scope of providing foreigners with free legal assistance and legal representation.
