Residence of foreigners in Poland due to the COVID-19 epidemic

New regulations concern a legal stay and a legal employment in Poland as well as postponing statutory deadlines which are mandatory to foreigners due to the current situation in Poland. This applies to situations when foreigners are required to leave the territory of the Republic of Poland within a given period of time, e.g. when the refusal decision on granting a temporary residence permit is final, when the date of a voluntary return is specified or when the foreigner has received a decision on obliging him to return and in this decision this deadline has been set.

Extension of foreigner’s legal stay who residing in Poland on the basis of a national visa or temporary residence permit, which ends within the period of state of epidemic emergency or state of epidemic, will be extended by law.

Till when? Untill the end of 30th day which will occur after the date of cancellation of the state binding as the last. Due to the extension of the deadline by law, there is no requirement to complete formalities – so you will not receive another visa sticker or residence card.

What is more, if you would like to submit an application for extension of a national visa  (D) or a Schengen visa (C), a residence permit such as: temporary, permanent, long-term EU resident  permit or extension of your stay within visa-free regime (Important! This applies to the citizens of Brazil, Argentina, Chile, Honduras, Costa Rica, Nicaragua, Singapore and Uruguay), it will be extended by the law for above-mentioned 30 days and the deadline for submission the application would also fall during the state of epidemic emergency or state of epidemic.

The above-mentioned 30-day period applies also to the legal employment. Work permit, seasonal work permit, declaration of the intention to commission work to a foreigner will also be extended by law (if its validity ends within the period of state of epidemic emergency or state of epidemic).

If your residence card expire during during the state of epidemic emergency or state of epidemic, you can submit an application for the replacement of the residence card, after Voivodeship Offices restore regular service.
